§1
General provisions
- The owner of the Site and the controller of the personal data provided while using the Site operated at www.sztukaharmonii.pl is Magdalena Raba, running a business under the business name RABA Magdalena Raba, ul. Konstantego Bergiela 4/10, 80-180 Gdańsk, NIP: 5833557278, who runs the “Psychological Centre Sztuka Harmonii”, e-mail contact for the data controller: rodo@sztukaharmonii.pl.

- The Site uses cookies to provide services and features tailored to the preferences and needs of its Users; in particular, cookies make it possible to recognise the User's device and to display the website appropriately, tailored to their individual needs.
- Cookies may be temporary, i.e. deleted when the browser is closed, or persistent.
- Persistent cookies are also stored after the User has finished using the Site and are used to store information such as a password or login, which speeds up and makes it easier to use the pages, and also makes it possible to remember the settings chosen by the User.
- The purposes for which cookies are used on the Site and accessed by other entities are set out later in this document.
- Information is processed in accordance with the laws currently in force, i.e. the Electronic Communications Law of 12 July 2024 (Prawo komunikacji elektronicznej), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: GDPR), and the Act of 10 May 2018 on data protection.

Definitions used
- Cookies - small files that are downloaded and stored on the User's computer or other device, linked to information about how the site is used.
- Personal data - any information which, without excessive time and cost, may lead to the identification of a natural person, including their identification, address and contact details.
- Third country - a country outside the European Economic Area (EEA).
- Site - the website available at www.sztukaharmonii.pl, through which the User can browse the content of the website and contact the personal data controller using the contact details or contact forms available on the site.
- User/data subject - a person who voluntarily uses the services and content available on the Site, i.e. browses the pages, places an order, registers, signs up for the free newsletter or contacts the owner of the Site via the contact form.
- End User – an entity using a publicly available electronic communications service, or requesting the provision of such a service, to meet its own needs. The User/data subject may also be an End User.
§3
Purposes of storing and accessing information contained in cookies.
- The Site uses cookies for the following purposes:
- adapting the content of the Site to the User's individual preferences and optimising the use of the web pages (display tailored to needs - functional cookies),
- carrying out analyses and statistics that provide information on how the User of the Site uses the pages, which makes it possible to improve their structure and content,
- marketing and/or remarketing, including directing dedicated content, in particular to Users who have visited the website or the fan page of the personal data controller on the Facebook and/or Instagram social network.
- Data contained in cookies will be archived and used for the purposes of statistical analysis and assessment of the overall traffic of users of the Site.
- Data contained in cookies are not combined with the personal data provided by the User when concluding and/or performing a contract or when contacting the personal data controller.
§4
Tools related to collecting or sharing cookies.
To analyse traffic on the Site, traffic sources and communication, and to optimise marketing activities, the following have been installed on the site:
- Google Analytics - a tool provided by Google LLC. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, which makes it possible to analyse the User's traffic on the Site and its subpages (country/city, number of visits, pages viewed, duration of visits, etc.). The main cookie used by Google Analytics, “_ga”, enables the service to distinguish between individual Users and remains active for 2 years. Each “_ga” cookie is unique to a specific service, so it cannot be used to track a user or browser on other, unrelated websites. The User can change the privacy settings in Google services; more information at: https://policies.google.com/privacy To permanently block cookies collected by Google Analytics, the User can use a browser add-on developed and provided by Google LLC at: https://tools.google.com/dlpage/gaoptout
- Facebook Pixel - a tool provided by Meta Platforms, Inc., Menlo Park, California/Meta Platforms Ireland Limited (formerly: Facebook Inc.), which enables measurement, optimisation and the creation of custom audiences, and makes it possible to collect information about the User's use of the Site and to direct dedicated content to them on social media (Facebook/Instagram). To control the privacy settings on these social networks, the User can change their preferences and settings at any time. More information at: https://www.facebook.com/privacy/ The Facebook Pixel makes it possible to create custom audiences and/or lookalike audiences of people who have already interacted with the Site or with the data controller's materials shared on the Facebook and/or Instagram social networks run by the data controller, with the retention of data provided by the Facebook Pixel being, in particular, respectively:
- website (Site) - up to 180 days from interaction with the website,
- Facebook fan page - up to 365 days from interaction with the account,
- video shared on the Controller's Facebook fan page - up to 365 days from interaction with the material,
- events organised or co-organised by the Controller on the Facebook fan page - up to 365 days from interaction with the material.
- Facebook/Instagram plug-in/widget - a tool that allows the User to go directly to the data controller's fan page on the Facebook/Instagram social network, run on a platform provided by Meta Platforms, Inc., Menlo Park, California/Meta Platforms Ireland Limited (formerly: Facebook Inc.). After moving to the Facebook and Instagram social networks, Users are additionally subject to the privacy rules described on that service, in particular at: https://www.facebook.com/privacy/
- YouTube plug-in/widget - allows the User to go to the YouTube channel - run by the data controller on that service. A tool provided by Google LLC. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, whose Users are additionally subject to the privacy rules described on that service, in particular at: https://policies.google.com/privacy
- LinkedIn plug-in/widget - allows the User to go to the LinkedIn service and to the professional profile run on that service by the personal data controller, provided by Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-7329 USA. Users are additionally subject to the privacy rules described on that service, in particular at: https://pl.linkedin.com/legal/privacy-policy
- TIK TOK plug-in/widget - a tool that allows the User to go directly to the data controller's fan page on the TIK TOK social network, run on a platform provided by Bejing ByteDance Technology Co Ltd., Room 503 5F Building 2 43 North Third Ring West Road Beijing, 100086 China. After moving to the TIK TOK social network, Users are additionally subject to the privacy rules described on that service, in particular at: https://www.tiktok.com/legal/page/eea/privacy-policy/pl
- As the data controller uses a tool for booking and scheduling appointments online called “Znany lekarz”, the site contains a link that allows the User to go directly to the specialist's profile on that service's website and, optionally, to book an appointment (if this option is available). The “Znany lekarz” service is operated by ZnanyLekarz Sp. z o.o. with its registered office in Warsaw (01-217) at ul. Kolejowa 5/7, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw, XII Commercial Division of the National Court Register, under KRS number 0000347997, NIP 7010224868, REGON 142276657. After going to znanylekarz.pl, the User should read the privacy policy of that service at https://www.znanylekarz.pl/prywatnosc
- Twilo - a tool provided by Twilo Inc., USA, used for communicating with users, which allows applications and websites to send messages, make calls and handle contacts automatically.
- Microsoft Clarity - an analytics tool provided by Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-7329 USA, used to analyse traffic and the actions performed on the website by the User.
- PostHog - an analytics tool provided by PostHog Inc., 2261 Market Street 4008, San Francisco, USA, used to analyse traffic and the actions performed on the website by the User.

Processing of information contained in cookies outside the EEA.
- The processing of data contained in cookies by providers whose registered offices and/or servers are located in a third country will involve the transfer of this information outside the European Economic Area (EEA), in particular the user's IP address and/or information about the pages visited.
- Data contained in cookies are transferred to the United States of America (USA) on the basis of the European Commission decision of 10 July 2023 finding an adequate level of protection of personal data ensured by the so-called “EU-US Data Privacy Framework” for providers entered on the US Department of Commerce list, such as: Google LLC., Meta Platforms, Inc., Microsoft Corporation, Twilo Inc., PostHog Inc.
- Where a provider does not use a mechanism ensuring an adequate level of protection of personal data, data are transferred to the USA on the basis of standard contractual clauses adopted by the European Commission.
- When communicating with the Controller on the TikTok platform, data may be processed by entities of the TikTok group, including ByteDance Ltd., whose infrastructure may be located in China; accordingly, personal data may be transferred outside the EEA on the basis of appropriate legal mechanisms, such as standard contractual clauses.
§6
Accepting, rejecting or changing cookie settings.
- On entering the Site, the User can accept the use of cookies for the above purposes, reject them or consent only to selected cookies.
- In accordance with Art. 399(2) of the Electronic Communications Law of 12 July 2024 (Prawo komunikacji elektronicznej), the User can give consent through the settings of the software installed on the telecommunications terminal equipment they use or through the configuration of the service.
- The User's consent to the installation, storage and sharing of cookies is voluntary. Consent may be withdrawn at any time. The User can at any time delete and/or disable cookies in the web browser they use when browsing the Site, or choose the appropriate cookie settings on the Site using the tools or other cookie management features on the site provided for this purpose by the owner of the Site.
- To manage cookies, the User can use the features available in the browser they are currently using. Instructions for managing cookies are available on the websites of web browser providers, in particular:

- Microsoft Edge - instructions
- The User's consent is not required if storing or accessing information contained in cookies is necessary to transmit an electronic communication over a public telecommunications network or to provide a telecommunications service or a service provided by electronic means requested by the end user.
- Entities providing services by electronic means may install software on the telecommunications terminal equipment of a subscriber or end user intended for using those services, or use that software, provided that the subscriber or end user:
- is informed directly, in an unambiguous, easy and understandable manner, before the software is installed, of the purpose for which the software will be installed and of the ways in which the service provider will use the software;
- is informed directly, in an unambiguous, easy and understandable manner, of how to remove the software from the user's telecommunications terminal equipment;
- consents to the installation and use of the software before it is installed.
- Deleting or disabling cookies may cause difficulties or limited functionality in some parts of the Site and/or (applies to functional cookies). This is because some cookies may be necessary for the Site to work properly, including remembering the User's settings and/or displaying content on the particular type of device the User is using.
§7
Final provisions
If the applicable Cookie Policy changes, in particular where required by the technical solutions used or by changes in the law on the privacy of Users, appropriate amendments will be made to the above text, which will apply 14 days after the date of their publication on the Site.
